Before you open ChatGPT the next time, pause for a moment. AI has settled into the recruiter's toolkit, but its use comes with risks you can't afford to ignore.

When used responsibly, AI is a recruiter's best assistant. Used carelessly, or unknowingly, it can lead to discriminatory practices, the loss of human-centric hiring, and even data protection breaches. And the EU AI Act, which fully applies from late 2027, raises the stakes further.

The deadlines moved, but the EU AI Act is coming

On May 7, 2026, the Council and Parliament agreed to push the high-risk obligations under Annex III (the section of the AI Act that covers employment systems) from August 2026 to December 2027. Good news, but not an excuse to wait.

A lot of the AI Act is already in force. AI literacy obligations took effect in February 2025. Biometric and emotion-recognition tools are prohibited in workplaces. Finland has given its market surveillance authority full enforcement powers, and other member states are following. Fines run up to €15 million or 3% of global turnover for deployer obligations, and €35 million or 7% for prohibited practices. Regulators can also pull a non-compliant AI tool off the market mid-contract.

Starting the work now means fewer surprises when the rules tighten in 2027.
